How to Handle a Sexual Harassment Claim from an Employee

Many companies have sexual harassment policies in place, for example. If you do not have one, that may be the first step necessary. When an employee comes to the business management or owner with a claim, you need to take action. But, what do you do?

First, Establish the Groundwork

Before you or your management team can take action, you simply must have a policy in place. State laws can apply to some of these requirements. In most cases, you will want to establish the following:

  • Determine how to communicate with employees about their ability to file a claim.
  • Make it clear that such harassment is something your business does not tolerate.
  • Educate your employees on what their rights are. Tell them what they must avoid to remain employed there.
  • Be sure to consult with an employment lawyer and create a harassment policy.
  • Be sure every employee reads, understands, and signs a document stating they understand this policy.

Once this is in place, your company has a plan of action to handle such an incident.

When an Employee Comes to You

When an employee brings a complaint to you or to your management team, you need to gather information. Do not violate any laws (check with your attorney on these). Gather just the details you need. Contact the police if a police report or charges are necessary. Then, contact your business insurance agent.

Your agent will handle the rest of the process. Your agent will handle any type of claim made against the business. Never admit guilt or promise to provide any specific support or service. It is very important that you simply gather information. In most cases, involving the police is best. Law enforcement will work to understand what occurred and gather data from all parties. They also can assign blame.

From a business insurance standpoint, companies simply need to trust their agent. Having proper liability insurance is essential. With the potential for a harassment claim possible in any business, you need coverage. Employee sexual harassment claim coverage helps protect you against claims made against your company.
